STOP US IF YOU’VE HEARD THIS BEFORE: Hardly for the first time, a president of the United States is threatening military action against a country without a Congressional declaration of war. This time, it is President Trump saber rattling with Iran. 

USA! USA! Trump being Trump – a man of no moral or intellectual substance – he is being very vague as to exactly what he wants and why. At least with some presidents – like George W Bush = they’ve been very clear as what they wanted and why. This didn’t make their wars any more legal. They were illegal because they were not declared by Congress. 

Write This Down: The US Constitution is very clear on the matter, with Article I, Section 8, Clause II stating: 

Congress shall have the power…To declare War. 

Dry, Technical Matter: It doesn’t say to pass a resolution authorizing the expenditure of funds or the sending of troops abroad. It doesn’t provide for a president to rustle up a coalition of like-minded nations to invade another country, and it certainly doesn’t provide for passing off the matter to the UN or NATO…Congress, and no one else, has the power to declare war. 

FunFact: Congress hasn’t declared war since World War II, on June 5, 1942, when we declared war against dreaded Romania, Bulgaria, and Hungary. Every other war America has fought since then – from Korea to our six current conflicts – have been or are illegal because they were not declared by Congress. 

The Bottom Line: America cannot continue to ignore the Constitution with impunity. Eventually, we will collapse. Now, if a majority of the members of the US House and Senate think we should be at war with someone, well, OK, that’s the Constitution at work. Having presidents declare war on their own is not.

In 1878 – The first telephone directory is issued in New Haven, Connecticut by the District Telephone Company. The directory consisted of a single piece of cardboard and listed 50 subscribers – only twelve of which were residences – and, interestingly, did not include numbers because people then picked up their phone and had an operator connect them. The first yellow pages appeared in 1886 in Chicago. 

In 1973 – The Chicago Blackhawks extend their NHL-record streak of consecutive games not being shut out in a 4-2 loss to the Montreal Canadiens. It was the 228th consecutive and final game with a goal for the Blackhawks, and the streak would end with a 2-0 loss to Pittsburgh on Feb 24. The mark broke the record of 134 consecutive games established by the Ottawa Senators from 1917-23, and the record was broken in 1983 by the Quebec Nordiques with 230, and is now held by the Calgary Flames, with 264, from 1981-85. 

In 1975 – The Average White Band is at #1 on the Billboard Hot 100 for the only week with Pick Up the Pieces. It was the first of five Top 40 hits for the group, their first of two Top 10s, and remains their only #1 song. The song also peaked at #6 in Great Britain, at #5 on Billboard’s soul chart, and was Billboard’s 21st-biggest song of the year. It was the sixth of twelve consecutive #1 songs in 1975 that spent only one week at the top, a Hot 100 calendar-year record that still stands.
